1. What the Pay Monthly Plans Include

Each Pay Monthly Website Plan includes:

• A professionally designed website according to the plan limits
• Hosting on our managed servers
• A free .uk domain (e.g. .co.uk, .uk) for as long as the plan remains active
• Basic technical setup and support
• Access to optional add-ons (extra cost)

If you want a domain with another extension (such as .com or .org), you may use one, but the additional cost is your responsibility.

2. Setup Fee

Each plan has a one-time setup fee that covers the design and initial build of your website.

• The setup fee becomes fully refundable after completing a 36-month contract term.
• If you cancel before the 36-month term ends, the setup fee is not refundable, and cancellation fees may apply.

3. Contract Term (36 Months) & Renewal

Your Pay Monthly Website Plan runs in 36-month contract cycles.

Initial 36-Month Term

• Your monthly price stays fixed during the entire 36 months.
• After completing 36 consecutive payments, you become eligible for a full refund of the setup fee if you choose to cancel.

Automatic Renewal

At the end of the 36-month term, the plan automatically renews for another 36 months unless you instruct us to cancel.

Rules for Renewed Terms

• The setup fee is not refunded during renewed terms unless cancelled at the end of that full cycle.
• If you cancel during a renewed 36-month term:
  • No refund is issued
  • Cancellation fees may apply
• No additional renewal fees apply.

Annual Price Adjustment

During renewed contract cycles, your monthly plan price may increase by up to 2% every April. We will notify you before any price change takes effect.

4. Billing

Your monthly plan fee is collected automatically using the payment method you provide.

Missed payments may result in temporary suspension of your website.

5. Cancellation

You may cancel anytime by emailing us at admin@empex.co.uk.

If you cancel before completing 36 months:

• The setup fee is not refunded
• Your website may be removed from hosting
• Cancellation or early termination fees may apply

If you cancel after completing 36 months:

• You may request a full refund of the setup fee
• You may request transfer of your domain and website files
• .uk domains are transferred for free

6. Domain Ownership

• A free .uk domain is included in all Pay Monthly Plans.
• The domain remains under our management while the plan is active.
• After 36 months and cancellation, the .uk domain can be transferred to you at no cost.
• For early cancellations, transfer may require an admin fee and may not be available if payments are overdue.

7. Website Ownership

Before completing 36 consecutive monthly payments, the website design, structure, and build remain the property of Empex Digital.

After completing 36 months and cancelling, ownership is transferred to you. Proprietary tools or internal frameworks remain Empex property.

8. Upgrading Your Plan

You may upgrade your plan at any time.

Upgrading a plan means:

• A new setup fee for the upgraded plan must be paid
• Your monthly cost increases according to the new plan
• The upgrade starts a new 36-month contract term
• Your previous setup fee is carried forward and may be refunded only after completing the new 36-month term

If you cancel the upgraded plan before completing its 36 months, no setup fees (old or new) are refunded.

9. Client Responsibilities

• Provide accurate business information, images, and content needed to build your website
• Ensure legal compliance of all content (GDPR, cookies, policies)
• Respond to design drafts and requests in a reasonable time
• Keep payment details active and up-to-date

10. Our Responsibilities

• Build your website according to the selected plan
• Host and maintain your website while the plan is active
• Keep core systems secure and updated
• Provide support and communication for billing, renewals, and updates

11. Add-Ons & Optional Services

Optional add-ons (extra cost) include maintenance, additional pages, increased media storage, booking systems, blogs, payment gateways, and other enhancements. Add-on pricing may change over time.

12. Acceptable Use

Websites must not contain illegal, harmful, infringing, or abusive content. We may suspend or remove websites that violate these rules.

13. Limitation of Liability

Empex Digital is not liable for loss of profits, business interruption, data loss, or issues caused by third-party providers. Our maximum liability is limited to the amount you paid in the 12 months before a claim.
