Pay-Monthly E-Commerce Plans – Terms & Conditions

1. Contract Length

All pay-monthly e-commerce plans are based on a 36-month fixed contract, with flexible cancelation and pause options defined below.

2. Ownership Policy

Full ownership of the e-commerce website (including files, design, and database) is transferred after 36 consecutive monthly payments have been made.

Alternatively, ownership may be granted after 24 monthly payments if the applicable cancelation fee is paid. Early cancelation before 24 months results in no ownership transfer, and Empex retains all rights to the store.

3. Cancel Anytime Policy

Customers may cancel their plan at any time by paying the plan-specific cancelation fee. This fee compensates for the build, setup, support, and licensing costs incurred by Empex.

No refunds are offered on the initial setup fee or past monthly payments.

4. Pause Policy

Customers may request to pause their plan for 3, 6, or 12 months. A reduced hosting/storage fee will apply during the pause period, based on the plan tier.

Ownership progress is paused during this period. Full payments must resume before further development or transfer takes place.

5. Payment Terms

Monthly payments are due on the agreed billing date each month. A grace period of 7 days is provided before late fees or account suspension may apply.

6. Missed Payments & Termination

If payment is not received within 21 days of the due date, the store may be temporarily suspended. If payment remains outstanding after 45 days, the contract may be terminated, and Empex reserves the right to remove all associated content and files from its servers.

7. Scope of Support

Ongoing support during the active payment term includes technical assistance, minor updates, and troubleshooting. Major customizations, app integrations, or redesigns may incur additional fees.

8. Data & Privacy

All customer data and store content will remain confidential and secured under AWS hosting and S3 storage. GDPR-compliant practices are followed by Empex Digital.
